Compulsory mobile number in car insurance policies from April 1, the Ministry of Road Transport and Union Highways said on Thursday.
The Ministry has issued a notification to mandate the Detailed Road Accident Investigation Procedure, Detailed Accident Report (DAR) and its report as well as timelines for various stakeholders for prompt settlement of claims by the Ministry. Automobile Accident Claims Tribunal (MACT).
Soon after receiving information about a traffic accident, the police investigator should inspect the accident site, take pictures of the accident scene and the vehicle(s) involved in the accident and prepare a site plan, the ministry statement said.
In injury cases, the Investigator (IO) will also take the pictures of the injured in the hospital, the notification said, adding that the IO should conduct a one-time investigation by examining eyewitnesses/bystanders, according to the notification.
The IO must report the accident to the Claims Tribunal within 48 hours of the accident, by submitting the First Accident Report (FAR) in Form I.
If details of the insurance policy are available, the notice of accident in Form I should also be delivered to the nodal officer of the relevant insurance company of the offending vehicle. A copy of Form I will also be provided to the victim(s), state legal services authority, insurer, and will also be uploaded to the state police website, if applicable, indicates the notification.
The notification stated that the IO will provide the description of the rights of road accident victims to the victim(s), or their legal representatives, within 10 days of the accident. The IO must also file a copy of Form II with the DAR, he added.
The investigator must provide a blank copy of Form III to the driver of the vehicle(s) involved in the accident, and the driver must provide the relevant information from Form III to the investigator, within thirty (30) days of the accident.
While in the case of one or more minor children of the accident victim(s), the notification indicates that the IO must provide a blank VIA-form to the victim(s), who must fill in the relevant information/attach relevant documents and submit the same to the investigator within 60 days of the accident.
